Murphy O'Rawe Protect the Rights of a Defendant in Medical Negligence Action

A High Court Queens Bench Master struck out a case against The Ulster Independent Clinic for failure to disclose a reasonable cause of action. Master Bell ruled that the plaintiff in the action had brought "unjustified" medical negligence proceedings against the Clinic and must pay its legal costs. This decision reflects the legal the principle that costs exists to protect not only an individual defendant who was sued when they should not have been, but to protect all in society from unjustified litigation
